Q: Can I use a document preparation service for my legal documents if I’m representing myself? Can legal document preparation be accomplished by anyone other than a lawyer?
A: This can be tricky. The safe answer is that nobody but an attorney, or a legal assistant/paralegal under the supervision of an attorney, should engage in giving legal advice unless they are licensed to practice law. To drive this point home, the State of Ohio does allow for the collection of damages against anyone who commits any act that the Supreme Court prohibits as being the unauthorized practice of law (Ohio Statute 4705.07 (A)(3)).
Besides the potential consequences to anyone who crosses the boundary into the unauthorized practice of law, the law is a complex and tricky thing. Our experienced firm partners spend years mentoring associate attorneys. All attorneys must complete mandatory annual training hours on top of their daily research and daily application of the law. In some ways, lawyers eat, sleep, and breathe this complex legal world. Even they still see new legal arguments and revisions to law popping up regularly. Because of this, we suggest that a licensed attorney creates legal documents. It may cost money, but it will almost always cost much more to defend an improperly designed legal document.
Q: Can I use an online legal document preparation program? Isn’t that the same thing?
A: Again, this can be tricky. You should be aware of what you are entering into as the consequences could be severe should your legal document not hold up in court. Online legal documents can be a cheap and fast way to create some primary documents. For those individuals who have few assets, the risk might be worth the cost savings.
Think of this a little like using Web.MD to diagnose your runny nose as a cold. The stakes are low, so if you get it wrong and your cold was allergies, it probably isn’t a big deal. The time spent avoiding the doctor’s office and associated bills might be worth it. Now imagine you misdiagnosed yourself and your condition was something life-threatening that a doctor could have identified. Not paying the doctor’s bill wouldn’t have been worth the time saved as your situation would become severe.

Attorneys can complete some legal documents for a flat fee. It is best to consult with an attorney so that you clearly understand what the cost will be.
Q: Will a document preparation attorney travel to me, or do I need to come to your offices in Lancaster or Canal Winchester?
While some meetings will need to occur in our offices, we try to minimize your travel time. We offer two convenient office locations in Lancaster and Canal Winchester, Ohio. Our goal is to reduce the disruption to your life caused by legal issues and conduct most communications or meetings through emails or phone calls. In certain circumstances, we realize that clients can’t reach us, and we may be required to visit your location. Suppose you retain a Dagger Law attorney to represent you. In that case, they will travel to the necessary court hearings and legal procedures to represent you anywhere in Ohio! Please note that in some instances, the cost to represent your case may require an unusual amount of money due to travel expenses. In such cases, we may recommend using legal representation closer to the location of your case. We are happy to provide referrals in these instances if we are able.
